Driving Under the Influence (DUI)
DUI is a charge that is generally used when police have not complied with the standards and procedures required to bring a successful drink driving (or PCA) charge.
This can happen under a number of different circumstances, such as if it was more than two hours between when you were behind the wheel and when your breath was tested.
DUI is also used when it is believed that a driver is under the influence of a prescription drug rather than alcohol.
This applies to legal drugs such as Valium, rather than illegal drugs.
In order for a successful DUI charge to be made, the police must prove that the drug was in the driver’s system while they were driving and, more importantly, that it was affecting their driving.
Police do this by alleging the driver’s actions; manner and demeanour were such that they were affecting the driver’s ability behind the wheel.
How can Sydney Drink Driving Lawyers help?
We have extensive experience helping clients fight DUI charges, and an outstanding record in defending DUI cases in court.
We can help our clients obtain pharmacological reports to indicate that the level of drugs or alcohol in their system would not be likely to have impaired their driving ability, and this is often enough for the police to withdraw their charges.
If the matter does go to court, we have a proven history of havinglegal costs awarded in our clients’ favour, due to the police refusal to withdraw charges, based on pharmacological reports evidence.
In the event that you decide to plead guilty, we can help ensure the best possible outcome when it comes to sentencing.
There are a number of programs that we can advise you of, which can help to mitigate the severity of a sentence, including the traffic offender program, alcohol interlock program and sober driving program.
We also have extensive experience in obtaining non conviction orders for our clients, when other lawyers have been unable to. With a section 10 dismissal or conditional release order, you plead guilty and the magistrate decides not to record a conviction, meaning you avoid disqualification and fines.
